Terms of Service

By accessing or using TagIt ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. Material changes will be communicated via email and a notice on the site. Your continued use of TagIt after changes take effect constitutes acceptance of the updated Terms.

TagIt provides an AI-powered resale pricing and listing platform. The Service allows you to:

• Upload photos of items and receive AI-generated identification and pricing estimates based on live market data.
• Track inventory, view price trends, and receive sell/hold recommendations.
• Generate listing titles, descriptions, and selling points powered by AI.
• Access marketplace features including listings, auctions, and our Done-For-You listing service.

Pricing estimates are advisory in nature and based on available market data at the time of scanning. Actual sale prices may vary based on market conditions, item condition, demand, and other factors beyond our control.

• You must be at least 18 years old to create a TagIt account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate and complete information when creating your account and to keep it up to date.
• One account per person. Automated account creation, bot usage, and credential sharing are prohibited.

You agree to use TagIt only for lawful purposes and in accordance with these Terms. Specifically, you may not:

• List, scan, or attempt to sell illegal items, stolen property, counterfeit goods, or items that violate any applicable law or regulation.
• Abuse the scanning system — including uploading excessive, irrelevant, or malicious images intended to disrupt or degrade the Service.
• Use automated scripts, bots, or scraping tools to access the Service without our express written permission.
• Upload content that is fraudulent, misleading, defamatory, obscene, or infringes on the intellectual property rights of others.
• Interfere with or disrupt the Service, its servers, or networks.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy, with or without notice, at our sole discretion.

TagIt offers both free and paid subscription tiers:

• Free tier — limited scans per month at no cost. No credit card required.
• Pro tier — $20/month, billed monthly. Includes unlimited scans, full historical trends, and AI listing assistance.
• Scale tier — $29/month, billed monthly. Everything in Pro plus priority support, future price projections, bulk scan mode, and reduced marketplace fees.

Paid subscriptions auto-renew at the end of each billing period unless cancelled. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are subject to change with 30 days' notice.

Marketplace transactions are subject to a 5% service fee (2.5% for Scale tier subscribers). Done-For-You listing fees are $10–$30 per item based on item value and are charged at the time of service fulfillment.

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that date.

We offer a 30-day money-back guarantee on all paid subscriptions. If you are unsatisfied for any reason within your first 30 days of a paid plan, contact us for a full refund. Beyond the initial 30 days, refunds are issued at our discretion on a pro-rated basis.

Done-For-You listing fees are non-refundable once the listing has been created and delivered. If a listing has not yet been fulfilled, you may cancel the request for a full refund of the DFY fee.

TagIt provides pricing estimates, market data, and listing assistance as advisory tools only. They are not guarantees of sale price, market demand, or transaction outcomes.

To the fullest extent permitted by law:

• TagIt is provided "as is" without warranties of any kind, either express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• We are not responsible for disputes between buyers and sellers, including payment disputes, item misrepresentation, or failed transactions.
• Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

TagIt brand: The TagIt name, logo, domain, website design, software code, and all related branding are the exclusive intellectual property of TagIt. You may not use our brand assets without prior written permission.

Your content: You retain full ownership of all content you upload to TagIt — including photos, item descriptions, and listing data. By uploading content, you grant TagIt a limited, non-exclusive license to use, display, and process that content solely to provide the Service to you (e.g., identifying items, generating pricing, displaying your listings).

We may use aggregated, anonymized data derived from user content to improve our AI models and Service. This aggregated data cannot be linked back to any individual user.

We want to resolve disputes fairly and efficiently. Before pursuing formal legal action, you agree to contact us first at support@tagithq.com so we can attempt to resolve the issue informally.

If informal resolution fails, any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place virtually or in a mutually agreed location.

You agree to resolve disputes on an individual basis. Class actions, class arbitrations, and representative actions are waived.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Delaware.

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include violation of these Terms, extended inactivity, or any conduct that we determine to be harmful to TagIt, its users, or third parties.

You may terminate your account at any time by contacting us or using the account deletion option in your dashboard. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
